Cart Hero – General Terms of Service This document outlines the terms of service for using Cart Hero products and services. By using the web site, or any service of Cart Hero, you agree to abide by these terms and conditions.
This document outlines the most common terms but is not the sole source for terms and services. This document may be updated at any time. Your use of the web site and other products and services constitutes acceptance of all terms.
All users agree to abide by all rules set forth and also agree to follow honest and respectful practices while using Cart Hero products and services.
All users agree to use all products and services for intended uses only.
Use of Cart Hero products and services are accepted as is. No warranties for availability or access are given beyond reasonable expectations. Downtime and maintenance are to be expected.
All accounts are intended for one person. You may access your account from any computer. Multiple account log-ins by more than one person is grounds for termination and possibly additional legal action.
Cart Hero may terminate any account at any time for any reason. This is to protect the interests of the company and its customers.
Cart Hero is intended for users 18 years of age and older. Younger visitors will need parental permission to use the Cart Hero Products. All users agree to abide by all laws local, national or international.
No discriminatory, hate or unlawful content or products are allowed. Any product, image, account or other materials deemed inappropriate may be dealt with as the company sees fit. Any material that has been deleted must remain off the site or property of Cart Hero. Again, Cart Hero reserves the right to close any account at any time for any reason.
Cart Hero is not responsible for how the products are used by the customer.
Cart Hero makes no warranties or promises concerning the maintenance or archiving of customers resources. Any image or file uploaded to Cart Hero’s server may or may not be saved or archived. Images and files may also be deleted at any time.
All property of Cart Hero, including software and scripts, are non-transferable without additional contracts. No code or software may be copied, changed or used for any other purpose.
No warranties or promises are made to keep or maintain user property beyond typical business practices. You will not bring a claim against Cart Hero based on "moral rights" or the likes arising from Cart Hero’s use of a Submission. All products created are owned by the user and Cart Hero. Cart Hero may use any product created for promotional uses at it’s own discretion.
No robots, auto-submission software or any other automated methods may be used to produce products using Cart Hero products or service. Automated use of any product or service is grounds for immediate account termination and may include additional legal action.
No part of the Cart Hero software may be used or reproduced outside of Cart Hero domains without express, written, consent.
Cart Hero may use third parties to provide additional products and services. Cart Hero does not control these third parties and is not responsible for their products, services or actions. Any problems or complaints need to be directed to the responsible party. Please notify Cart Hero of any such actions.
Accounts are granted based upon typical use. Any account that goes beyond typical usage patterns may be subject to additional fees and restrictions.
Users agree to hold Cart Hero harmless in the case of any third party legal actions involving users or members in which Cart Hero products or services are involved but where the legal action is not directly related to Cart Hero actions, products or services.
All disputes arising out of, relating to or connected with these terms or your use of any part of the Cart Hero products or services will be exclusively resolved under confidential binding arbitration held in Cumberland County, Maine before and in accordance with the Rules of the American Arbitration Association, by a sole arbitrator applying Maine law.
Cart Hero - Intellectual Property Rights Cart Hero LLC provides online and offline services to our users, which they can use to create, purchase and sell products. Users are contractually prohibited from using any Cart Hero service or product to purchase or sell merchandise that may infringe upon third party intellectual property rights.
If you are an intellectual property rights owner you may wish to contact us if you believe that a user of our service may have infringed on your rights. To correct a situation we feel violates your rights, we may require the user to remove the contested content from the products and, if the user continues to infringe upon your rights or the rights of others, their account may be terminated.
If you believe that your intellectual property rights have been infringed upon, please send us the following information:
1. Send us a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or other rights that have been allegedly infringed.
2. Positive identification of the legal copyright, trademark or other rights that have been allegedly infringed. 3. The url or some sales material showing the products in question.
4. Your name, address, telephone number and email address. State the preferred communication method.
5. A signed statement that you have reason to believe that the use of the material in the manner explained is not authorized by the owner, its agent or the law.
6. A signed statement that the information in the notification is accurate to the best of your knowledge and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright.
